Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Moozaik application ("Moozaik"), the website moozaik.app, and related services, operated by Alba IT, a company organized under the laws of Switzerland. By creating an account, accessing, or using Moozaik, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference and available at moozaik.app/privacy. If you do not agree, please do not use Moozaik.

2. The Service

Moozaik is an AI-powered workspace that lets you create projects, manage conversations, and process content using large language models. During the public beta, Moozaik is made available to all registered users for evaluation and improvement. Moozaik runs its own AI inference on Alba IT's own hardware in Switzerland first; when demand exceeds on-premises capacity, overflow inference may be routed to third-party model providers as described in our Privacy Policy.

3. Acceptable Use

You agree to use Moozaik only for lawful purposes and in accordance with these Terms. You must not:

• Use Moozaik to generate, store, or transmit content that is unlawful, infringing, fraudulent, defamatory, hateful, or that breaches the rights of third parties.
• Attempt to reverse engineer, decompile, or interfere with the operation or security of Moozaik.
• Use Moozaik to probe, scan, or test the vulnerability of the service, or to circumvent any access or usage limits.
• Upload content that contains malicious software, or that violates applicable export or data-protection laws.
• Use Moozaik to build a competing product or to extract data at scale for that purpose.
• Misuse the usage analytics controls or otherwise attempt to de-anonymize the service.

4. Accounts

To use Moozaik you may need to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must provide accurate information and keep it up to date. You must promptly notify us of any unauthorized use of your account. You must be at least 16 years old to use Moozaik.

5. Your Content and Our Use of It

You retain all rights to the content you upload, submit, or generate through Moozaik ("Your Content"). You grant Alba IT a limited, non-exclusive, worldwide license to process, store, and transmit Your Content solely for the purpose of providing and improving the service. We do not sell Your Content, and we do not monetize it. We never use Your Content to train AI models, and we never train on data originating from Moozaik.

You are solely responsible for Your Content, including ensuring that it does not infringe the rights of third parties and that its processing complies with applicable law. We may remove, suspend, or refuse content that we reasonably believe violates these Terms or applicable law.

6. AI Inference and Data Handling

Your workspace data is processed as described in our Privacy Policy. In summary: Moozaik runs its own inference on Alba IT hardware in Switzerland; overflow inference may be routed to EU-based, GDPR-aligned providers under contracts that prohibit training, long-term retention (no more than 30 days), and any sale or monetization of your data. Anonymized usage analytics are on by default during the public beta and can be turned off at any time under Settings. Our data protection commitments are set out in full in the Privacy Policy.

7. Billing, Payment, and Fees

During the public beta, Moozaik may be offered without charge. If paid plans are introduced, applicable fees, billing cycles, and payment terms will be presented to you before you subscribe. Payment data is processed by our payment provider and is not stored by us. Unless otherwise stated, fees are exclusive of any applicable Swiss value-added tax (VAT) or other taxes, which will be added where required. We may change prices for future subscription periods by giving you reasonable notice.

8. Intellectual Property

Moozaik, including its software, design, trademarks, and all content owned by Alba IT, is the property of Alba IT and its licensors and is protected by Swiss and international intellectual property laws. Except for the limited license to use the service under these Terms, no rights are granted to you in Moozaik or its underlying technology.

You retain ownership of Your Content. To the extent the AI models and service outputs derive from Alba IT's technology, you may use outputs in connection with your use of Moozaik in accordance with these Terms.

9. Third-Party Services

Moozaik may rely on third-party services, including model providers and infrastructure services, to deliver the service. Your use of Moozaik is subject to these Terms and our Privacy Policy; your relationship with any third parties is governed by their own terms. We are not responsible for third-party services, but we require the providers we use to meet the data-protection commitments described in our Privacy Policy.

10. Disclaimers

The service is provided on an "as is" and "as available" basis. To the fullest extent permitted by Swiss law, Alba IT makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, and does not guarantee that Moozaik will be uninterrupted, error-free, or secure, or that AI outputs are accurate, complete, or suitable for any purpose.

AI-generated outputs may be incorrect or inappropriate. You are responsible for reviewing and validating outputs before relying on them. Moozaik is not medical, legal, financial, or professional advice.

11. Limitation of Liability

To the fullest extent permitted by Swiss law, Alba IT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or in connection with your use of Moozaik. Our aggregate liability for any claim arising out of or relating to these Terms or your use of the service shall not exceed the greater of CHF 1,000 or the amounts you paid to us in the twelve (12) months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable Swiss law, including for intent, gross negligence, or personal injury.

12. Termination

You may stop using Moozaik or terminate your account at any time. We may suspend or terminate your access to the service, in whole or in part, if you breach these Terms, if it is reasonably necessary to protect the security or integrity of the service or other users, or as otherwise required by law. Upon termination, we will handle your data in accordance with our Privacy Policy, including the deletion timelines described therein.

13. Data Protection and Privacy

Your privacy is governed by the Moozaik Privacy Policy, which is incorporated into these Terms. It describes the data we process under the Swiss Federal Act on Data Protection (new FADP), the legal bases for processing, data transfers, your rights under the new FADP, and how to contact the Federal Data Protection and Information Commissioner (FDPIC). You have rights of access, rectification, erasure, portability, and objection, as set out in that policy.

14. Changes to These Terms

We may update these Terms from time to time. The current version is always available at moozaik.app/terms. Material changes will be communicated to you in the app or by email before they take effect. Your continued use of Moozaik after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law and Disputes

These Terms are governed exclusively by Swiss substantive law, excluding its conflict-of-law principles and the UN Convention on Contracts for the International Sale of Goods (CISG). Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of 1400 Yverdon-les-Bains, Switzerland, subject to any mandatory consumer-protection provisions that apply in your country of residence.
